1. Acceptance of Terms

By accessing or using the SnapsDrops platform (hereinafter referred to as the "Service" or "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree to any part of these terms, you may not access or use the Service. The Service is provided solely on the terms set forth in this document, without additional warranties, commitments, or obligations except where required by applicable law.

2. Service Overview

SnapsDrops is a web-based platform that enables event organizers to create shared photo and video galleries for their events. Guests may contribute content without registration by scanning a QR code or using a shared link provided by the organizer. The Service is intended for private use in connection with events such as weddings, birthday celebrations, graduations, corporate events, and similar occasions.

The Service is provided on an "as is" and "as available" basis. SnapsDrops reserves the right to modify, expand, limit, suspend, or permanently discontinue the Service, or any part thereof, at any time and for any reason, with or without notice, and without liability to any user.

3. Account Registration and User Responsibilities

Access to certain features of the Service requires account registration. By creating an account, you represent that all information you provide is accurate and that you will maintain its accuracy throughout your use of the Service. You are solely responsible for:

• all activities that occur under your account, including content uploaded by guests via your shared QR code or link
• maintaining the confidentiality of your login credentials and preventing unauthorized account access
• controlling the distribution of your event's QR code and shared link
• ensuring that any person accessing your event gallery via the shared link or QR code does so with your authorization

You must be at least 18 years of age to use the Service. SnapsDrops reserves the right to suspend, restrict, or permanently terminate any account at any time, for any reason or no reason, with or without prior notice.

4. User Content

You are solely responsible for all content uploaded, submitted, or otherwise made available through your account or event gallery — including content uploaded by guests who access your event via the shared QR code or link. SnapsDrops does not pre-screen, monitor, review, or approve user-generated content.

You agree not to upload or permit the uploading of content that:

• is unlawful, defamatory, obscene, pornographic, harassing, threatening, or otherwise objectionable
• infringes upon the intellectual property rights, privacy rights, or other rights of any third party
• contains malware, viruses, or other harmful code
• violates any applicable local, national, or international law or regulation

SnapsDrops reserves the right, but assumes no obligation, to remove content that violates these terms at any time and without prior notice. By uploading content to the Platform, you represent and warrant that you hold all necessary rights, permissions, licenses, and consents for such content.

5. Content License

You retain all ownership rights to the content you upload to the Platform. By uploading content, you grant SnapsDrops a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your content solely as necessary to provide and operate the Service as described in these Terms.

SnapsDrops does not use user-uploaded photos, videos, or other content for marketing, advertising, promotional materials, public showcases, or any external communications.

6. Payment and Billing

Access to certain features of the Service requires a one-time payment. The base price for this Service is 24.99 EUR. For your convenience, the Platform displays an estimated price in your local currency, based on your detected location. This displayed price is provided for informational purposes only and does not constitute a binding offer. The final price is determined exclusively by PayPro Global at checkout, based on your location and currency selection at that time, and may differ from the price displayed on the Platform. Payment processing is handled by PayPro Global, which acts as the Merchant of Record and is solely responsible for payment processing, invoicing, tax compliance, and related matters.

Service access is activated immediately upon payment confirmation. SnapsDrops is not responsible or liable for any payment failures, processing errors, delays, or disputes arising from or related to the payment processing services provided by PayPro Global.

Prices displayed on the Platform are subject to change at any time without prior notice.

7. Refund Policy

All purchases are final and non-refundable. By completing a purchase, you acknowledge and agree that you have reviewed the Service features and these Terms of Service, and that you accept this no-refund policy.

No refunds, credits, or exchanges will be issued under any circumstances, including but not limited to:

• partial or non-use of the Service
• dissatisfaction with Service features or functionality
• technical issues, downtime, or unavailability of the Service
• change of mind after purchase
• loss of content due to technical problems or expiration
• account suspension or termination for violation of these Terms

If you believe there is a valid reason for a refund, you may contact us at [email protected]. Each request will be reviewed on an individual basis, however SnapsDrops is under no obligation to approve any refund request.

8. Storage Duration and Content Deletion

Each event has a storage duration of 3 months from the date of activation. After this period, all associated content — including photos, videos, and the gallery itself — may be automatically and permanently deleted without prior notice.

It is your sole responsibility to download and archive any content you wish to retain before the expiration of the storage period. SnapsDrops does not maintain backups of user content and assumes no obligation to recover, restore, export, or provide access to any deleted or expired content.

SnapsDrops also reserves the right to delete or make unavailable any content earlier than the 3-month period where permitted by law or where required to enforce these Terms.

9. Disclaimers and Limitation of Liability

The Service is provided on an "as is," "as available," and "with all faults" basis. To the fullest extent permitted by applicable law, SnapsDrops disclaims all warranties, representations, and conditions of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, reliability, security, data preservation, and uninterrupted or error-free operation.

SnapsDrops does not guarantee that the Service, QR codes, shared links, uploads, downloads, galleries, or any other feature will function without interruption, be free from errors, or meet your expectations.

To the fullest extent permitted by applicable law, SnapsDrops shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages of any kind arising from or related to your use of or inability to use the Service, including but not limited to loss of data, content, revenue, business, or reputation.

Use of the Service is entirely at your own risk.

10. Intellectual Property

All content, trademarks, logos, and intellectual property associated with SnapsDrops remain the exclusive property of SnapsDrops or its licensors. You are granted no rights to such intellectual property other than those expressly set forth in these Terms.

You may not copy, modify, distribute, reproduce, or create derivative works from any SnapsDrops content, trademarks, or intellectual property without prior written consent from SnapsDrops.

11. Third-Party Services

The Service integrates with third-party services including but not limited to Clerk (authentication), Cloudflare (infrastructure and storage), and PayPro Global (payment processing). Your use of these third-party services is subject to their respective terms of service and privacy policies. SnapsDrops is not responsible or liable for the acts, omissions, or services of any third-party provider.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, processing, and use of your information as described in the Privacy Policy.

13. Modifications to Terms

SnapsDrops reserves the right to modify these Terms of Service at any time, for any reason, with or without prior notice. Updated terms will be published on the Platform and will take effect immediately upon publication unless otherwise stated. Your continued use of the Service following the posting of revised terms constitutes your acceptance of such changes. You are responsible for reviewing these Terms regularly.

14. Termination

SnapsDrops reserves the right to terminate, suspend, restrict, or disable access to any account, event, gallery, or feature of the Service at any time and for any reason, with or without prior notice. SnapsDrops shall not be liable for any consequences, damages, or losses arising from such termination or suspension.

15. Governing Law and Jurisdiction

These Terms of Service and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Belgrade, Republic of Serbia.

16. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and SnapsDrops regarding your use of the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Service.
